Terms of Use
These Terms govern access to ActivityLock, an educational activity, assessment, monitoring, PDF annotation, AI marking, and analytics platform. By creating an account or using the platform, you agree to these Terms.
1. Scope and account responsibility
ActivityLock is provided for lawful educational, assessment, training, supervision, and activity management purposes. Account owners are responsible for the accuracy of account information, keeping credentials secure, preventing unauthorized sharing, and supervising how their users configure and use the platform.
Teachers, institutions, and administrators are responsible for ensuring that their use of ActivityLock is appropriate for the age, location, legal status, and consent requirements of their students or participants.
2. Monitoring and exam integrity tools
ActivityLock may include browser focus detection, fullscreen prompts, activity locking, screen or webcam permission flows, PDF annotation tracking, device and browser signals, timing records, activity logs, screenshots or evidence when enabled, live preview features, and related monitoring data. These tools support exam integrity but do not guarantee prevention or detection of all misconduct.
Institutions and teachers decide which monitoring features to enable. They must provide legally required notices and obtain legally required consents from students, parents, guardians, staff, or examinees before using monitoring features, especially where minors are involved.
3. AI marking and analytics
AI marking, similarity flags, cognitive level labels, review warnings, and analytics are decision-support tools. They may be incomplete, inaccurate, delayed, or unsuitable for a particular exam. They must not be treated as a final disciplinary decision or final grade without teacher or institution review.
Teachers and institutions remain responsible for grading decisions, academic judgment, student accommodations, appeals, and any consequences based on monitoring or AI outputs.
4. Student data and educational records
ActivityLock may process educational records, submissions, marks, exam content, annotations, metadata, logs, and analytics on behalf of teachers or institutions. Where laws such as FERPA, GDPR, COPPA, UAE data protection law, or other local rules apply, the teacher or institution is responsible for using ActivityLock consistently with its legal obligations and notices.
For students under the age of majority, the school, institution, teacher, or authorized administrator is responsible for determining whether parental, guardian, institutional, or student consent is required before use.
5. Acceptable use
You must not use ActivityLock to break the law, infringe rights, harass users, conduct unauthorized surveillance, bypass security controls, reverse engineer the platform, overload systems, share accounts, manipulate monitoring results, upload malicious files, or use the platform in restricted jurisdictions or prohibited environments.
Students and participants must follow the rules set by their teacher or institution. Attempting to bypass exam controls, manipulate device signals, spoof identity, submit unauthorized work, or interfere with monitoring may lead to account restrictions or reporting to the relevant teacher or institution.
6. Device, browser, internet, and third-party services
ActivityLock depends on compatible browsers, operating systems, device permissions, internet stability, Firebase, Google Drive, OneDrive, Stripe, AI providers, email providers, and other third-party services. We do not guarantee that every device, network, browser, extension, firewall, school filter, camera, microphone, or screen sharing permission will work.
You are responsible for testing devices and networks before high-stakes exams. We are not responsible for outages, browser restrictions, denied permissions, lost connectivity, unsupported devices, third-party service changes, or failures outside our reasonable control.
7. Payments, subscriptions, credits, and refunds
Paid plans, add-ons, institution seats, AI marking credits, storage limits, and usage allowances may be billed through third-party payment processors. Payment approval, card authentication, taxes, exchange rates, bank failures, and checkout availability may be controlled by those providers.
Unless required by law or expressly stated in a written order, subscriptions, add-ons, and consumed credits are not guaranteed to be refundable. We may correct billing errors, delay fulfillment during fraud review, and suspend access for failed payment, chargeback, abuse, or account misuse.
8. Intellectual property and user content
ActivityLock, its software, design, workflows, UI, documentation, and platform logic are protected by intellectual property laws. You may not copy, resell, reverse engineer, scrape, or build a competing service from the platform except where law expressly allows.
You retain rights to your uploaded exam content and submissions, subject to the rights needed for ActivityLock to host, process, transmit, analyze, display, export, back up, and secure that content for platform operation.
9. Security, storage, and data loss
ActivityLock uses technical and organizational safeguards, but no system is perfectly secure. You are responsible for secure devices, account credentials, authorized storage integrations, and avoiding malware or compromised networks. We are not responsible for breaches caused by user devices, shared passwords, third-party accounts, browser extensions, or misconfigured institution systems.
Users should keep appropriate backups of important exam materials and exported records. Cloud storage, sync delays, accidental deletion, third-party account disconnection, or provider outages may affect access to files.
10. Disclaimers and limitation of liability
ActivityLock is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, uninterrupted operation, error-free operation, non-infringement, and guaranteed exam integrity outcomes.
To the maximum extent permitted by law, ActivityLock and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, punitive, exemplary, or lost-profit damages; lost data; lost exam time; lost opportunity; monitoring disputes; grading disagreements; AI inaccuracies; or third-party service failures.
Where liability cannot be excluded, our total aggregate liability will be limited to the amount paid for the affected service during the three months before the event giving rise to the claim, or USD 100 if no amount was paid, unless a higher amount is required by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless ActivityLock from claims, damages, penalties, losses, and expenses arising from your content, your configuration of monitoring settings, your failure to obtain required consent, your misuse of the platform, your violation of law, or disputes with students, parents, guardians, employees, institutions, or payment providers.
12. Suspension, termination, and enforcement
We may suspend or terminate access, remove content, limit usage, refuse transactions, or preserve evidence where we reasonably believe there is abuse, fraud, security risk, unlawful use, payment failure, harm to other users, or violation of these Terms.
13. Disputes and governing principles
Before starting a formal claim, the parties should first try to resolve disputes in good faith through written notice and support escalation. Where legally allowed, disputes may be resolved through confidential binding arbitration or competent courts determined by the applicable customer agreement, billing agreement, or mandatory local law. Nothing limits rights that cannot legally be waived.
14. Changes to these Terms
We may update these Terms. Material updates may require renewed acceptance before continued use. The version accepted by a user may be stored with timestamp, user agent, device information, and request metadata for audit purposes.
